The Centre has clarified that police stations are not allowed to be used for audio-visual examination of witnesses, as per Sections 266, 268, and 308 of the BNSS.
These sections, which have replaced the CrPC, specify that witnesses can only be examined through audio-video electronic means at designated locations that are to be notified by the State government.
This clarification ensures that the legal procedures are followed correctly and that witness testimonies are obtained in a secure and appropriate manner.
The recent replacement of the Code of Criminal Procedure (CrPC) of 1973 by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has brought about significant changes in the way witnesses are examined in criminal cases.
However, the Union Ministry of Home Affairs has made it clear that police stations or any premises controlled by the police department cannot be designated as these examination locations, ensuring a more neutral and secure environment for the process.
