Binaliktad ng Court of Appeals (CA) ang dismissal order ni dating Presidente Rodrigo Duterte laban kay dating National Capital Region Police Office chief Major General Joel Pagdilao dahil sa umano'y kabiguan ng huli sa pagsawata sa illegal drug trade sa rehiyon.

Inakusahan ni Duterte sa publiko si Pagdilao at ilan pang Philippine National Police officials ng pagpoprotekta sa mga operasyon sa droga.

Sa December 20, 2023 decision, binago ng CA Eight Division ang ruling ng Office of the President noong October 2017 na si Pagdilao ay may pananagutan para sa 'serious neglect of duty and serious irregularity in the performance of duty' at iniutos na tanggalin ito sa serbisyo.

Sinabi ng CA na si Pagdilao ay may pananagutan lamang sa 'simple neglect of duty' na dapat lamang pangaralan.

Nauna rito, pinagtibay ng Office of the President ang rekomendasyon ng National Police Commission na si Pagdilao ay dapat matanggal dahil sa pagbalewala sa sulat ni noo'y Quezon City Vice Mayor Joy Belmonte na naglalaman ng pagbabatikos ng mga residente tungkol sa Stations Anti-Illegal Drugs-Special Operations Task Group, at pagtata-laga ng mga opisyal na walang training at may mga rekord ng pang-aabuso sa anti-illegal drugs task group.

Iniakyat ni Pagdilao ang findings sa Court of Appeals.

Sa kanilang decision, sinabi ng appellate court na si Pagdilao ay liable lamang sa 'simple neglect of duty' nang mabigo itong sagutin ang sulat mula kay Belmonte, at dapat lamang pangaralan.

Sinabi ng CA na ang aksyon na ito ay hindi pasok sa mga kasalanang "grave" sa ilalim ng Napolcom Memorandum Circular, at ito'y kinokonsidera lamang na halimbawa ng kabiguan para mag-"coordinate or cooperate with other law enforcement agencies and their personnel."

Ito'y nagpapahiwatig ng "disregard of duty resulting from carelessness or indifference, but not a flagrant or culpable refusal or unwillingness of a person to perform a duty, so as to amount to Serious Neglect of Duty," saad nito.

Binigyang-diin din na ang sulat ni Belmonte ay inindorso lamang ng tauhan ni Pagdilao sa concerned police units.

Dahil dito, sabi ng CA, si Pagdilao ay walang pananagutan sa ilalim ng Doctrine of Command Responsibility sa gawang palokong drug cases ng police personnel dahil hindi nakitaan na mayroon siyang kinalaman sa naturang mga iregularidad.

Walang ebidensiyang inilatag para patunayan na ang mga iregularidad sa anti-drug operations ay talamak, at ang immediate subordinates ni Pagdilao ay sangkot, sabi ng CA.

Nilinis din ng korte si Pagdilao sa 'serious irregularity in the performance of duty'.

Ang decision ng CA ay pinirmahan ni Associate Justice Jaime Fortunato Caringal, at sinang-ayunan nina Associate Justices Ramon Cruz at Louis Acosta.
